Terms of Service

These Terms apply to every visitor and registered user of the Services. By accessing the Services in any way (including by browsing, registering an account, uploading a selfie, or making a purchase), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization (for example, as an event organizer), you represent that you have authority to bind that organization to these Terms.

You must be at least eighteen (18) years old to use the Services. By using the Services, you represent and warrant that you are 18 years of age or older, or that you are the parent or legal guardian of a minor and consent to that minor's use of the Services on your behalf. We do not knowingly collect personal information from children under 18.

You must also not be barred from receiving the Services under the laws of any applicable jurisdiction, including the country in which you reside.

EventLens is an AI-powered face-recognition photo platform that helps event attendees discover and download photos taken of themselves at events organized by third-party Event Organizers ("EOs"). The Services typically work as follows:

• Event Organizers upload event photos to EventLens and create an event listing.
• Attendees access the event page (via a QR code, link, or direct URL), upload a selfie, and EventLens uses face-recognition technology to find photos in which the attendee appears.
• For free events, matched photos can be viewed and downloaded at no charge.
• For paid events, matched photos are displayed with a watermark; attendees may purchase a bundle to unlock and download a chosen number of photos at full resolution without a watermark.

We do not capture event photos ourselves. We host, process, and serve photos provided by Event Organizers, and match them to attendees using face-recognition technology.

Some Services require account registration. You agree to provide accurate, current, and complete information during registration and to keep this information up to date. You are responsible for safeguarding your login credentials and for all activity under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security at [email protected]. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

One person may hold multiple accounts only where each account corresponds to a distinct identity (for example, you may hold an Attendee account and an Event Organizer account). Creating multiple Attendee accounts to circumvent payment, slot limits, or any other restriction is prohibited.

By using the Services, you agree that you will not:

• Upload a photograph of any person other than yourself as a selfie, including but not limited to photographs of public figures, friends, or photographs sourced from the internet, in order to find or download their photos.
• Use the Services to identify, surveil, harass, or track any other person.
• Attempt to download, redistribute, or republish photos that do not depict you, including by tampering with selfies, exploiting matching errors, or any technical means.
• Remove, alter, or attempt to bypass any watermark, paywall, encryption, signed-URL expiry, or other access control on any content delivered by the Services.
• Reverse-engineer, decompile, scrape, automate, or otherwise programmatically extract content or face-recognition results from the Services.
• Upload content that is unlawful, defamatory, sexually explicit, infringing, or that violates any third-party right.
• Use the Services in a manner that interferes with the Services' security, performance, or availability for other users.
• Resell, sublicense, or commercially exploit access to the Services without our prior written consent.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this section, including reporting them to law enforcement and terminating their account.

Event Photos

Photos uploaded to EventLens by Event Organizers ("Event Photos") are owned by the EO or by the photographers who took them, in accordance with the EO's arrangements. EventLens does not claim ownership of Event Photos. By using the Services, you acknowledge that copyright in Event Photos belongs to the EO or its licensors.

When you download a photo through EventLens (whether free or as part of a paid bundle), you receive a personal, non-exclusive, non-transferable, revocable license to use that photo for personal, non-commercial purposes (for example, posting on your personal social media). You may not resell, license, sublicense, distribute as a commercial service, or use the photo for advertising or product promotion without separate written permission from the rights-holder.

Your Selfie and Biometric Data

You retain ownership of your selfie. By uploading a selfie, you grant EventLens a limited, revocable license to process the selfie and the biometric data extracted from it strictly for the purpose of operating the Services (matching you to Event Photos, securing your account, preventing fraud, and complying with law). You may revoke this license at any time by deleting your account or by contacting us; revocation does not affect processing already lawfully performed before revocation.

EventLens Content

All other content on the Services, including the EventLens name, logo, software, design, and interface, is owned by us or our licensors and is protected by Indonesian and international intellectual-property laws. You receive no rights to such content other than the right to use the Services in accordance with these Terms.

Pricing

Prices for paid bundles are set by the Event Organizer and shown on the relevant event page and at checkout before you confirm payment. All prices are in Indonesian Rupiah (IDR) and are inclusive of any applicable taxes unless stated otherwise.

Payment Processing

Payments are processed by our payment partner, Xendit. Once you click "Pay," you will be redirected to a Xendit-hosted payment page. By completing payment, you agree to Xendit's terms and privacy policy in addition to these Terms. EventLens does not store your full payment instrument details.

Bundles and Slots

A "bundle" gives you a fixed number of download slots that you may use to claim photos that match your face within the same event. A photo, once claimed against a slot, remains available for download by you until the event's data retention period expires (see our Privacy Policy). Slots from one bundle may be used across multiple sessions until exhausted; once exhausted, additional photos require purchasing a new bundle.

Refund Policy

Because each bundle delivers immediate, irrevocable access to digital content, all sales are final and refunds are generally not provided. We will, however, consider refunds at our discretion in cases such as:

• A duplicate charge caused by a technical error.
• A failed payment that nonetheless resulted in a charge to you.
• A documented service failure that prevented you from claiming or downloading photos within a reasonable time after payment.

Refund requests must be submitted within seven (7) days of the original charge to [email protected] and must include the entitlement ID shown on your payment receipt.

EventLens uses a Face Recognition System to extract facial features from your selfie and match them against faces detected in Event Photos. By using the Services, you give your informed consent to this processing for the purpose of finding photos in which you appear at events you attend.

Biometric face data and selfies are automatically deleted thirty (30) days after the end of each event. You may also request deletion at any time by contacting us at [email protected].

Face recognition is statistical and may produce false positives or false negatives. EventLens does not guarantee that every photo of you will be found, nor that every matched photo will depict you. If a matched photo does not depict you, please notify us using the contact details below and refrain from downloading it.

Your privacy is important to us. Our collection, use, and disclosure of your personal information are described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the data practices described in the Privacy Policy.

We strive to keep the Services available and reliable, but we do not guarantee that the Services will be uninterrupted, error-free, secure, or free of viruses, harmful code, or other defects. Scheduled maintenance, force-majeure events, third-party outages (including our cloud infrastructure provider, Xendit, or your own internet service provider), and bugs may cause temporary unavailability.

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR THAT FACE-RECOGNITION RESULTS WILL BE COMPLETE OR ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL EVENTLENS, EXPOCONNECT, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) IDR 500,000.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you in full.

You may terminate your account at any time by contacting us. Upon termination, we will deactivate or delete your account and associated personal information in accordance with our Privacy Policy.

We may suspend or terminate your access to the Services, with or without notice, if you breach these Terms, if your account shows signs of fraud, abuse, or unauthorized access, or if we are required to do so by law. Upon suspension or termination, your right to use the Services ends immediately. Provisions of these Terms that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute-resolution provisions) will survive.

We may revise these Terms from time to time. The revised version will be indicated by an updated "Last updated" date at the top of this page and will be effective as soon as it is posted. If we make material changes, we will provide you with reasonable advance notice (for example, by email or by an in-app notice). Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.

These Terms and any dispute arising out of or relating to these Terms or the Services are governed by the laws of the Republic of Indonesia, without regard to its conflict-of-laws principles. The parties agree to submit any disputes to the exclusive jurisdiction of the competent courts of Jakarta, Indonesia, except where prohibited by mandatory consumer-protection laws of your country of residence.

Before initiating any formal legal action, the parties agree to first attempt to resolve any dispute informally by contacting [email protected] and allowing thirty (30) days for a good-faith resolution.
